Right of rescission

You have the right to withdraw from the contract under certain conditions. The withdrawal period is fourteen days from the day on which you, or a third party designated by you (other than the carrier), took possession of the goods. 

Please be sure to note the following information, which explains when this right of withdrawal does not apply or applies only to a limited extent: 

1. Please do not break the seal on copyable media. We will only accept returns of shrink-wrapped or sealed software and data storage media if they remain in their original shrink-wrap or with the seal intact. You have no right to return data storage media that you have unsealed or removed from the shrink-wrap. 

2. The right of withdrawal does not apply to software sold as a download licence. 

3. Items suitable for parcel post must be returned in the event of withdrawal. If you are unable to return the goods received, either in full or in part, or can only return them in a deteriorated condition, you may be required to compensate us for the loss in value. Return postage costs are generally to be borne by the buyer. 

4. We cannot generally accept returns sent carriage forward. Please therefore ensure that returns are adequately prepaid. 

5. Most of our software products are programmes for Apple Macintosh computers, which only work on computers running Mac OS.

You will find relevant information in the system requirements for the individual products, amongst other places. This software cannot be run on Microsoft Windows. Please understand that we cannot accept returns of incorrect orders where the packaging has been opened or the shrink-wrap removed. 

6. We also reserve the right, where necessary, to provide a service that differs in quality and price but is of equivalent value, or to not fulfil the contract in the event that the promised service is unavailable. 

To exercise your right of withdrawal, you must inform us (Application Systems Heidelberg Software GmbH, Eckener Str. 5, 69121 Heidelberg) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax or email). Simply returning the goods is not sufficient. You may use the model withdrawal form on our website for this purpose, although this is not mandatory. 

To meet the withdrawal deadline, it is sufficient for you to send notification of your decision to exercise your right of withdrawal before the withdrawal period expires.

Consequences of withdrawal 

If you withdraw from this contract, we shall refund all payments we have received from you without delay and at the latest within fourteen days of the day on which we receive notification of your withdrawal from this contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you. We may withhold the refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us without delay and, in any event, no later than fourteen days from the date on which you notify us of your withdrawal from the contract. The deadline is met if you post the goods before the end of the fourteen-day period. You shall bear the direct costs of returning the goods.
